ACT + MEANS + PURPOSE = TRAFFICKING
When defining Trafficking three core elements are required unless it pertain to a MINOR. ( Minor is 18 years of age and under)
1. ACTION of trafficking which means the recruitment, transportation, transfer, harboring or receipt of persons (Polaris project, 2012). 2. MEANS of trafficking which includes threat of or use of force, deception, coercion, abuse of power or position of vulnerability (Polaris project, 2012). 3. PURPOSE of trafficking which is always exploitation. Exploitation shall include, at a minimum, the exploitation of the prostitution of others forms of sexual exploitation, forced labor or services, slavery or practices similar to slavery, servitude or the removal of organs (Polaris project, 2012)). |
Human TraffickingThe Trafficking Victims Protection Act of 2000 is to combat trafficking in persons, a contemporary manifestation of slavery whose victims are predominantly women and children, to ensure just and effective punishment of trafficking, and to protect their victims(Congress.gov, 2015). Sex Trafficking is the recruitment, harboring, transportation provision or obtaining of a person for the purposes of a commercial sex act is induced by force, fraud, or coercion, or in which the person induced to perform such an act has attained 18 years of age (Polaris project, 2012). Forced Labor is the recruitment, harboring, transportation provision or obtaining of a person for labor services through the use of force, fraud, coercion for the purposed of subjection to involuntary servitude, peonage, debt bondage or slavery (Polaris project, 2012). Forms of Bondage Involuntary servitude-Includes a condition of servitude by means of any scheme, plan, or pattern intended to cause a person to believe that, if the person did not enter into or continue in such condition that person or other person would suffer serious harm or physical restraint or abuse or threatened abuse of the legal process (Polaris project, 2012). Peonage- Holding someone against his or her will to pay debt (Polaris project, 2012). Debt bondage- It begins when a person accepts a loan form a moneylender, often in order to purchase basic necessities such as food or medicine. The person (and his or her family as well) are held as collateral against the loan (Polaris project, 2012). Slavery- the process of coercing labor or other services from a captive individual, through any means including exploitation of bodies or body parts. Slave trading represents the supply side of trafficking whereas slavery represents the demand side (Polaris project, 2012). |

Human Trafficking Protection Act (2000) provides victims or survivals with empowerment through providing a means of protection, prevention, prosecutions, and provisions in order to support the victim or survival with a healthy integration back into society ( Congress.gov, 2015).
